1. AGREEMENT TO TERMS Welcome to the 63 South Mini Storage website. By accessing our Platform, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website.
2. MANDATORY LIEN NOTICE (RSMo 415.415) Pursuant to Missouri law, the operator of a self-service storage facility has a lien on all personal property stored within each leased space for rent, labor, or other charges. Property stored in the leased space may be sold to satisfy such lien if the occupant is in default.
3. SELF-STORAGE DISCLOSURES (RSMo 415.410)
- Residential Use Prohibited: Occupants are strictly prohibited from using any leased space for residential purposes (living or sleeping).
- Third-Party Liens: Occupants must provide a written statement of the name and address of any person or entity having a valid lien against the property to be stored.
- No Bailment/Insurance: The Company does not take care, custody, or control of your property. We do not provide insurance. Storing property is at your sole risk.
- Value Limitation: The total value of all property stored shall not exceed $5,000. This is the maximum liability of the Company for any claim of loss or damage.
4. ELIGIBILITY & ACCOUNTS You must be at least 18 years old to use this Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
5. INTELLECTUAL PROPERTY All content, logos, and trademarks on this Website are the property of 63 South Mini Storage. You may not reproduce or use our intellectual property without express written consent.
6. USER CONDUCT & INDEMNITY You agree not to use the Website for any unlawful purpose or to post offensive/harmful content. You agree to indemnify 63 South Mini Storage against any claims or losses arising from your misuse of the Website or breach of these Terms.
7. LIMITATION OF LIABILITY To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from your use of the Website, even if we have been advised of the possibility of such damages.
8. FORCE MAJEURE Neither party shall be liable for failures or delays in performance due to causes beyond their reasonable control, including acts of God, utility failures, or government actions.
9. GOVERNING LAW This Agreement is governed by the laws of the State of Missouri. You submit to the exclusive jurisdiction of the Missouri courts for any disputes.
